Terms of Use

These Terms of Use ("Terms") govern your use of the Level Up Performance Training website and online enrollment. By using the site or enrolling, you agree to these Terms.

Eligibility

You must be at least 18 to submit an enrollment. Enrollments for athletes under 18 must be completed by a parent or legal guardian, who is responsible for the account and for payment.

Enrollment & payment

Enrollment sets up an athlete and (where applicable) a guardian account in MindBody. Payment is completed on MindBody's secure hosted checkout. The introductory offer applies to new participants and may be limited.

Membership, auto-renewal & cancellation

Our membership is month-to-month. The introductory offer is $99 for your first month of unlimited access. Unless you cancel, your membership then automatically renews each month at $219/month (unlimited), charged to the payment method on file, until you cancel. There is no long-term contract or minimum commitment.

Cancellation. You may cancel at any time during your first 30 days and pay only the $99 first month, with no further charges. After the first 30 days, cancellation requires 30 days' advance notice, and charges continue during that notice period. To cancel, email your request to jesse@levelupperformancetraining.com.

Prices and offer terms are as described at the time of purchase and may change on a going-forward basis.

Acceptable use

You agree to provide accurate information, to use the site only for lawful purposes, and not to attempt to disrupt, damage, or gain unauthorized access to the site or its systems.

Health & participation

Training and physical activity carry inherent risks. Participation is subject to any waivers, releases, and health acknowledgements Level Up requires. Consult a physician before beginning any new exercise program.

Intellectual property

The Level Up name, logo, and site content are owned by Level Up or its licensors and may not be used without permission.

Third-party services

Our enrollment and payments rely on MindBody and other third-party services, which have their own terms and privacy practices. We are not responsible for third-party services.

Disclaimers & limitation of liability

The site is provided "as is" without warranties of any kind. To the fullest extent permitted by law, Level Up is not liable for indirect, incidental, or consequential damages arising from your use of the site.

Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the site will be brought exclusively in the state or federal courts located in San Mateo County, California, and you consent to the personal jurisdiction of those courts.

Changes

We may update these Terms from time to time; updates will be posted here with a new "Last updated" date.
